These are the three main eligibility requirements:
- The business or company you work for has to be a subscriber to the Texas Workers’ Compensation System and have workers’ compensation insurance
- You are an employee of that business or company
- The injury or illness is work-related
How do you know if your injury is work-related? If you are in the course and scope of your employment when you sustain an injury then it is considered work related. The general rule of thumb is that any time you are carrying out the duties of your job or following a supervisor’s orders, you are in the course and scope of your employment. Keep in mind, however, that independent contractors may not be covered because the employer does not consider them an employee of the company. Also, remember that some companies may not carry workers’ comp insurance.
