Houston Workers' Comp Disputes Attorneys

Lawyers Serving Victoria and Port Lavaca

A dispute can arise during a workers' compensation case even if the insurance company initially accepts your claim. If you are experiencing a dispute, reach out to Recalde Law Firm, PLLC. Our Houston workers' compensation attorneys are experienced in dealing with disputes.

Workers' compensation disputes generally occur due to the following factors:

  • Denial of workers’ compensation claim
  • Choice of treating doctor
  • Entitlement to weekly benefits
  • The amount of your weekly benefits
  • The extent of injury or injuries the insurance company is accepting
  • Mileage reimbursement
  • Date of MMI and impairment rating disputes

Recalde Law Firm, PLLC has aggressive attorneys who are ready to represent you against the insurance company. Our Houston workers' compensation lawyers can request a Benefit Review Conference to address the disputed issues in your claim. The BRC is held at your local field office of the Division of Workers' Compensation, and is like a mediation where all parties come together and review the facts under the supervision of a Benefit Review officer. If an agreement is reached, then a benefit dispute agreement form is drafted and signed by both parties. If an agreement is not reached, then the BRC is set to gather additional information or set for a Benefit Contested Case Hearing or BCCH.

Representation in Possible Appeals

If your case is set for a Benefit Contested Case Hearing, or BCCH, you have limited time to gather important documents and information to present at the hearing. The BCCH is a formal hearing to present evidence to a Hearing Officer who makes a decision on the disputed issues of your claim. It is important to have legal representation to protect your rights and we can handle your case with experience and dedication.

If you are not satisfied with the results of your hearing, you can file an appeal to the Appeals Panel in Austin, Texas explaining why the Hearing Officer's decision is incorrect. No new evidence can be presented to the Appeals Panel. After reviewing your case, they will issue a written decision based on the evidence.
